1. Acceptance of Terms

By accessing or using the BuiltToKillUSA website, purchasing products, scheduling services, or interacting with our business in any way, you agree to be bound by these Terms of Service. If you do not agree to these terms, you may not use our services or purchase our products.

2. Company Information

BuiltToKillUSA is an automotive aftermarket company offering performance products, accessories, fabrication services, installation services, and related automotive products. All references to “we,” “our,” or “us” refer to BuiltToKillUSA.

3. Product Use & Intended Purpose

Many products sold by BuiltToKillUSA are intended for off-road or racing use only and may not be legal for use on public roads in certain states or countries. It is the customer’s responsibility to understand and comply with all local, state, and federal laws regarding emissions, noise regulations, and vehicle modifications.

4. Vehicle Modifications & Risk Acknowledgement

Customer acknowledges that performance modifications may increase wear on vehicle components, affect drivability, void manufacturer warranties, and increase the risk of mechanical failure. BuiltToKillUSA shall not be held responsible for damages resulting from misuse, improper installation, racing, abuse, tuning issues, or use outside manufacturer recommendations.

5. Installation Responsibility

Unless explicitly stated otherwise, the customer is responsible for ensuring proper installation of all products. Professional installation is strongly recommended. BuiltToKillUSA is not responsible for damage caused by improper installation, incorrect vehicle fitment verification, fabrication changes made by third parties, or failure to follow instructions.

6. Product Fitment & Compatibility

Customers are responsible for verifying fitment before purchase. Vehicle production changes, aftermarket modifications, regional differences, and prior repairs may impact compatibility. Minor adjustments may be required during installation of aftermarket performance products.

7. Shipping Policy

Shipping times are estimates only and are not guaranteed unless explicitly stated. Delays caused by carriers, customs, weather, production timelines, or supply chain disruptions are outside of our control. Risk of loss transfers to the customer upon shipment.

8. Returns, Refunds & Cancellations

All returns must be approved prior to being sent back. Returned items may be subject to restocking fees. Products that have been installed, modified, damaged, used, or missing packaging are generally non-returnable. Custom-built, made-to-order, special-order, or fabricated products are non-refundable. Cancellation requests submitted after production or shipping has begun may be denied or subject to fees.

9. Warranty Disclaimer

Unless otherwise explicitly stated in writing, products are sold “AS IS” without any express or implied warranties, including merchantability or fitness for a particular purpose. Any optional warranty offered by BuiltToKillUSA is limited solely to repair or replacement of the defective product at our discretion.

10. Limitation of Liability

BuiltToKillUSA shall not be liable for indirect, incidental, special, consequential, or punitive damages including but not limited to loss of use, vehicle downtime, towing costs, labor costs, lost profits, personal injury, property damage, or engine failure arising from the use of our products or services.

11. Tuning & Calibration

Some aftermarket products may require proper ECU tuning or recalibration for safe operation. Customers are responsible for obtaining appropriate tuning and verifying safe operation after installation.

12. Intellectual Property

All product designs, branding, logos, graphics, media, descriptions, videos, CAD files, engineering concepts, and website content remain the property of BuiltToKillUSA unless otherwise stated. Unauthorized reproduction, copying, distribution, or commercial use is prohibited.

13. User Content & Media

By submitting reviews, photos, videos, or tagged social media content featuring BuiltToKillUSA products, the customer grants BuiltToKillUSA a non-exclusive, royalty-free right to repost, distribute, and use such content for marketing and promotional purposes.

14. Chargebacks & Fraud Prevention

Customers agree to contact BuiltToKillUSA before initiating payment disputes or chargebacks. Fraudulent chargebacks, false claims, or unauthorized transaction disputes may result in legal action and recovery efforts.

15. Pricing Errors

BuiltToKillUSA reserves the right to cancel orders resulting from pricing errors, website glitches, inventory inaccuracies, or typographical mistakes.

16. California Proposition 65

Certain products may expose users to chemicals known to the State of California to cause cancer, birth defects, or reproductive harm. Customers acknowledge and accept any applicable Proposition 65 warnings.

17. Indemnification

You agree to defend, indemnify, and hold harmless BuiltToKillUSA, its owners, employees, contractors, and affiliates from claims, damages, liabilities, costs, and expenses arising out of your use of products or violation of these Terms.

18. Governing Law

These Terms shall be governed by and interpreted under the laws of the State of California without regard to conflict of law principles. Any disputes shall be handled exclusively in California courts.

19. Changes to Terms

BuiltToKillUSA reserves the right to modify these Terms of Service at any time without prior notice. Continued use of our website or services constitutes acceptance of updated terms.
